Terms and Conditions

These Terms and Conditions ("Terms") govern your use of executivefinance.ca (the "Site") and the services offered by Executive Finance Partners ("Executive Finance," "we," "us," or "our"), including continuing professional development (CPD) courses, e-learning, executive coaching, corporate training, and related content. By using the Site or purchasing our services, you agree to these Terms.

1. Acceptance of Terms

By accessing the Site, enrolling in a course, or engaging our coaching or training services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

2. Description of Services

Executive Finance provides continuing professional development courses, e-learning content, executive coaching, corporate training, and thought leadership content, including a blog, podcast, and published books. E-learning courses are delivered through Teachable, a third-party platform, which has its own terms of service and privacy policy governing your use of that platform.

3. Educational Purpose Only

All courses, coaching, training, blog content, podcast episodes, and books provided by Executive Finance are for general educational and professional development purposes only. Nothing on the Site or in our services constitutes personalized financial, investment, legal, accounting, or tax advice. You should consult a qualified professional before making decisions based on any content we provide.

4. Privacy

Our collection and use of your personal information is described in our Privacy Policy, which forms part of these Terms by reference. By using the Site or our services, you also agree to the terms of our Privacy Policy.

5. Eligibility and Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. You are responsible for maintaining the confidentiality of any login credentials associated with your account.

6. E-Learning Purchases and Refunds

E-learning courses purchased through Teachable are refundable within 30 days of purchase. To request a refund utilize the policies established on the Teachable platform. Refunds requested after 30 days from the date of purchase will not be granted, except where required by law.

7. Executive Coaching and Corporate Training

Executive coaching and corporate training engagements are governed by the cancellation terms set out in the individual contract or engagement agreement between you (or your organization) and Executive Finance. These Terms do not override or replace the terms of that agreement. Where no separate agreement exists, contact us before booking to confirm applicable cancellation terms.

8. Intellectual Property

All content on the Site, including text, course materials, videos, graphics, logos, podcast episodes, and books, is the property of Executive Finance or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent, except for your own personal, non-commercial use of purchased course materials.

9. Testimonials and Results

Testimonials and success stories shared on the Site reflect individual experiences. They are not a guarantee that you will achieve similar results. Outcomes from coaching, training, or course completion depend on individual circumstances and effort.

10. Third-Party Links and Services

The Site may link to third-party websites or services, including Teachable, social media platforms, and partner organizations. We do not control and are not responsible for the content, policies, or practices of these third parties. Use of any third-party service is subject to that service's own terms and privacy policy.

11. Limitation of Liability

To the maximum extent permitted by law, Executive Finance and its principals, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, courses, coaching, or training, including but not limited to loss of profits, business interruption, or loss of data. Our total liability for any claim arising from these Terms or our services will not exceed the amount you paid for the specific service giving rise to the claim.

12. No Warranty

The Site and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

13. Indemnification

You agree to indemnify and hold Executive Finance harmless from any claims, losses, damages, or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site or our services.

14. Termination

We may suspend or terminate your access to the Site or to a course if you breach these Terms. Provisions of these Terms that by their nature should survive termination, including intellectual property rights, limitation of liability, and indemnification, will survive.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Nova Scotia and the laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Nova Scotia.
